1. Definitions

For the purpose of this policy, the following terms are defined as follows:

a. Any use of “We” and “Us” refers to Watts Wildlife Photography LLC.

b. “Workshop” means any photography workshop organized and hosted by Watts Wildlife Photography LLC.

c. “Participant” means the individual registered for the workshop.

d. “Deposit” means the initial payment made to Watts Wildlife Photography LLC to reserve a spot in a workshop.

e. “Future Workshop” means a Watts Wildlife Photography LLC workshop occurring within two years of the start date of the originally scheduled workshop.

2. Payments

a. Reservation and Deposit: To secure your spot in any workshop, a Deposit is required. Deposits are non-refundable. You will need to complete the Workshop Participant Agreement and submit your Deposit within 14 days of receiving payment instructions.

b. Payment Schedule: Final payment for all workshops is due 90 days prior to the start of the workshop, unless otherwise specified. For registrations made within 90 days of the workshop, the full balance is due immediately. Payments may be made by credit card (with a 3% service charge added to all credit card payments) or ACH bank transfer.

c. Late or Missed Payments: If final payment is not received by the due date, your workshop reservation will be cancelled, and your Deposit will be forfeited without refund. If extra time is needed to send final payment, please inform us in advance, and in some cases we may be able to make exceptions.

d. Watts Wildlife Photography LLC has no obligations and Participant has no rights under this Policy until the Deposit is paid in full.

3. Cancellations

To cancel your reservation, you must email us at evan@wattswildlifephotography.com.

If you cancel more than 90 days before the workshop start date, you will receive a full refund minus a $250 cancellation fee, provided your spot in the workshop is filled by another paying client. If your spot is not filled by another paying client, no refund will be issued.

Cancellations within 90 days prior to the workshop start date are non-refundable and non-transferable.

This is why it is important you protect your workshop trip with travel insurance (see Section 8).

4. No-Show, Late Arrival, or Early Withdrawal

Participants are responsible for being at workshop events on time. No refunds, changes, or delays will be granted if you miss any portion of the workshop for any reason, including, but not limited to, travel delays, injury, illness, emotional state, or other circumstances.

If you withdraw from the workshop on or after the first day, for any reason, no refunds, transfers, or credits of any kind will be issued.

5. Workshop Cancellation by Watts Wildlife Photography LLC; force majeure policy

In the event of a force majeure, including but not limited to government shutdown, natural disaster, weather event, war, strike, pandemic, epidemic, or any other reason beyond the control of Watts Wildlife Photography LLC, the company and its service providers reserve the right to cancel a workshop, change the dates of a workshop, change the itinerary of a workshop, or end a workshop early.

If Watts Wildlife Photography LLC cancels a workshop due to a force majeure, the full deposit paid can be transferred to a Future Workshop of your choice. The remainder of the payment (minus deposit) is non-refundable.

If Watts Wildlife Photography LLC cancels a workshop for any other reason, including but not limited to, bodily injury or illness of the workshop leader, too few participants signing up, or personal emergency, the full amount paid can be transferred to a Future Workshop of your choice.

Transfer to apply the payment to a Future Workshop is limited to one transfer per booking. Participant must make the selection within one (1) year and must use the booking within two (2) years. Transfers are non-transferable to other persons unless approved. Additional costs may be required if the chosen Future Workshop is a different price.

No refunds will be issued in the event of a cancelled workshop.

6. Date Changes or Early Termination

If workshop dates are changed, a full refund will be issued to participants who are unable to attend the new dates, if and only if your spot in the workshop is filled by another paying client.

If your spot in the workshop is not filled by another paying client, a refund will not be issued. Alternatively, the full amount paid can be transferred to a future workshop of your choice.

If a workshop is ended early, a 25% refund will be issued to all participants.

Watts Wildlife Photography LLC reserves the right to revoke or refuse service for any reason, including but not limited to safety violations, harassment, illegal conduct, failure to follow instruction, and intoxication. Offending Participant will be issued one verbal warning. If a Participant is asked to leave or is removed from the Workshop for cause, no refund will be issued to the Participant.

7. Credit/Debit Card Processing Fees

A 3% service charge will be applied to all credit and debit card payments.

Card processing fees are non-refundable for Participant-initiated cancellations. If we cancel for non-force majeure reasons, we will refund card fees.

8. Travel Insurance

Travel insurance is highly recommended to protect against unforeseen circumstances that may prevent you from attending, or lead to workshop cancellation or changes. It is best to purchase this as soon as possible after paying your deposit.

Third-party costs, such as airfare and hotels not arranged by Watts Wildlife Photography LLC, are participant’s responsibility and nonrefundable by Watts Wildlife Photography LLC.

There are many reputable travel insurance providers and aggregators. Squaremouth is a great option that is simple to use and can provide you with numerous quotes. Squaremouth can be found here: https://www.squaremouth.com/

9. Governing Law; Venue; Mediation

a. Governing Law: This Agreement shall be governed by, and construed in accordance with, the laws of the State of Montana, without regard to its conflicts-of-law principles.

b. Exclusive Venue. The parties agree that any legal action, suit, or proceeding arising out of or relating to this Agreement shall be instituted exclusively in the state or federal courts located in Gallatin County, Montana, and each party irrevocably submits to the exclusive jurisdiction and venue of such courts and waives any objection thereto based on forum non conveniens or otherwise.

c. Mediation Requirement. As a condition precedent to initiating any legal action, suit, or proceeding arising out of or relating to this Agreement, the parties shall first attempt in good faith to resolve any dispute, claim, or controversy through non-binding mediation. The mediation shall be conducted in Gallatin County, Montana, by a mutually agreed mediator. The parties shall share the mediator’s fees and mediation administrative costs equally, with each party otherwise bearing its own attorneys’ fees and costs. All applicable statutes of limitation and contractual limitations periods shall be tolled from the date a party delivers a written request to mediate until the earlier of (a) the date the mediator declares an impasse in writing or (b) 60 days after the mediator’s appointment, unless extended by written agreement of the parties. Notwithstanding the foregoing, either party may seek temporary, interim, or provisional injunctive or equitable relief in a court of competent jurisdiction in Gallatin County, Montana, to prevent irreparable harm, provided that the seeking party concurrently pursues mediation as required herein.
