Watts Wildlife Photography LLC (“we,” “us,” “our”) is based in the Greater Yellowstone Ecosystem. We operate Evan Watts’s wildlife photography portfolio, YouTube channel, gallery offerings, workshops, prints, gear guides, and newsletter.
3. Intellectual Property
All content on the Website—including but not limited to photos, videos, blog posts, gear guides, and workshops—is owned by Watts Wildlife Photography LLC. The materials on this Website are copyrighted and any unauthorized use of any materials at this Site may violate copyright, trademark, and other laws.
You may view or download content solely for personal, non-commercial use, provided you credit the source and leave copyright notices intact. The materials on this Website are provided without any express or implied warranty of any kind.
4. User Conduct

All purchases of prints, calendars, and bookings for workshops or private tours are subject to the terms outlined in our Payment, Cancellation, & Refund Policy. Please review that policy carefully before making a purchase or reservation.
6. Payments & Third-Party Services
All purchases (prints, calendars, workshops) are processed through third-party services. We do not store or control payment data.
Watts Wildlife Photography LLC is not responsible or liable for any acts, errors, omissions, representations, warranties, breaches, or negligence of any third parties, including third-party platforms, venues, transport providers, or content providers, or for any personal injury, death, property damage, or other damages or expenses resulting therefrom.
You agree to the Terms and Privacy Policies of those providers.
7. Limitation of Liability
No Warranty; Assumption of Risk. All content and services are provided on an “as is,” “as available,” and “with all faults” basis. Without limiting the foregoing, Watts Wildlife Photography LLC makes no representations or warranties regarding quality, accuracy, timeliness, reliability, availability, fitness for a particular purpose, non-infringement, or completeness of any photographs, deliverables, guide services, itineraries, recommendations, schedules, or website functionality. You acknowledge that photography outcomes and guide services inherently involve variables and subjective factors, and you assume all risks arising from your reliance on or use of the foregoing.
To the maximum extent permitted by applicable law, Watts Wildlife Photography LLC shall not be liable for any damages, losses, or expenses of any kind arising out of or related to: (a) your access to, use of, or inability to use the website, mobile applications, or related digital services; (b) the purchase, receipt, access, use, or performance of any photography, image files, prints, digital downloads, editing, or related services; (c) any guide, tour, instruction, itinerary, recommendation, or other guiding or informational services, whether provided in person or digitally; or (d) any errors, omissions, interruptions, defects, delays in operation or transmission, bugs, malware, or other technical or security issues affecting the Website or any associated systems or networks.
Cap on Direct Damages. To the extent any liability is not otherwise disclaimed or excluded, the total aggregate liability of Watts Wildlife Photography LLC for any and all claims arising out of or related to the Website or the services shall not exceed the amount you actually paid to Watts Wildlife Photography LLC for the specific service or deliverable giving rise to the claim during the 12-month period preceding the event first giving rise to liability. This limitation is cumulative and will not be increased by the existence of more than one claim.
Exclusion of Certain Damages. To the maximum extent permitted by law, in no event shall Watts Wildlife Photography LLC be liable for any: (a) indirect, incidental, special, exemplary, punitive, or consequential damages; (b) loss of profits, revenue, goodwill, data, or anticipated savings; (c) business interruption; (d) personal injury or property damage not directly caused by Watts Wildlife Photography LLC’s willful misconduct; or (e) cost of substitute goods or services, in each case arising out of or related to the website or the services, whether based on warranty, contract, tort (including negligence), strict liability, or any other legal theory, even if Watts Wildlife Photography LLC has been advised of, or could have foreseen, the possibility of such damages.
Allocation of Risk; Essential Basis; Jurisdiction-Specific Exceptions. The limitations, exclusions, and disclaimers in this section apply to the fullest extent permitted by law and reflect an agreed allocation of risk between you and the Company Parties. They form an essential basis of the bargain and without them the pricing and availability of the Site and services would be materially different. Some jurisdictions do not allow the exclusion or limitation of certain damages or implied warranties. Solely to the extent such laws apply to you, some of the above exclusions and limitations may not apply, and the liability of the Company Parties will be limited to the minimum extent required by applicable law.

Your use of the Website is also governed by our Privacy Policy (effective April 30, 2026), which outlines how we collect, use, and protect your personal data.
9. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Montana.
Any disputes must be resolved in the courts of Montana.
10. Changes to This Agreement
We may update these Terms at any time. We will post revised Terms on the Website with a new Effective Date. Continued use after changes indicates acceptance.
